HEARING OFFICER ORDER
On February 4, 2005, the petitioners filed a motion for summary judgment. On March 1,
2005, the respondents filed a motion for stay of petitioners’ motion for summary judgment.
Pending the decision by the Board regarding the motion to stay, the briefing schedules regarding
the motion for summary judgment as found in the February 7, 2005, hearing officer order is
hereby suspended and will be revisited at the next telephonic status conference if needed.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on April 28, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
