FACTS
1.
That Ken
Edwards (“Respondent”) is the present owner and
operator of a facility
located
at
3655
Edwardsville
Road,
Edwardsville,
Macoupin
County,
Illinois.
The
property
is
commonly known to the Illinois Environmental Protection Agency as Woodburn/Edwards.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency
Operating Permit and
is designated with
Site Code
No.
1178045001.

3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on January24, 2005, Jan Mier of the
Illinois Environmental Protection Agency’s
Rockford
Regional Office
inspected the above-described facility.
A copy of her inspection report
setting forth the
results of said
inspection
is attached hereto and made a part hereof.
VIOLATIONS
Based upon direct observations made by Jan Mier during the course of her January 24, 2005
inspection of the above-named facility, the Illinois Environmental Protection Agency has detemiined

that
Respondent has
violated the Illinois
Environmental
Protection
Act
(hereinafter, the “Act”) as
follows:
(1)
That
Respondent caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of Section
21(p)(1)
of th.~Act, 415
ILCS 5/21(p)(l)
(2002).
CIVIL
PENALTY
On June 22, 2000, the Board found Ken Edwards in violation of Section 21 (p)(1
)
of the Act in
AC 04-47.
Because this Administrative Citation addresses a second orsubsequent violation of Section
21(p)(l)
of
the Act,
pursuant to
Section
42(b)(4-5)
of the
Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent is subject
to
a
civil penalty of Three
Thousand Dollars
($3,000.00) for each
of the
violations identified above,
fora total of Three Thousand Dollars ($3,000.00).
If Respondent elects
not to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and
payable
no
later than
April
15, 2005,
unless
otherwise
provided
by order of the
Illinois
Pollution
Control Board.
IfRespondent elects to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board in acôordance with
Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control
Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall
be assessed the associated hearing costs incurred by the Illinois
Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in addition
to
the Three Thousand Dollar
($3,000.00) statutory civil penalty for each violation.

inspection ofan open dump, located in Macoupin County, Illinois and known as
Woodburn/Edwards
by the Illinois
Environmental Protection Agency.
Said
site has been
assigned site code number LPC

by the Agency.

Afflant inspected
said site by an on-site inspection, which included walking and
photographing the
site.
4.
As a result ofthe activities referred to in Paragraph 3 above, Affiant completed the
Inspection Report
form attached hereto and made a part hereof, which, to the bestof
Affiant’s knowledge arid belief, is an accurate representation ofAffiant’s observations and
factual conclusions with respect to

January 24,
2005,
I conducted an inspection at the above-referenced site.
I was
accompanied by Paul Eisenbrandt, DLPCIFOS
Springfield Regional
office.
This site
has been used for open dumping in
the past.
An Administrative Citation (AC 00-08) was
issued to the property owner, Ken Edwards on ‘May
1,
2000.,
The site was returned to
compliance on 9/27/00, but no letter was sent
to Mr. Edwards because he never submitted
receipts verifying the proper disposal of the waste.
Mr. Edwards owns salvage yards in
Alton and Edwardsville, IL.
An inspection was last conducted on 5/11/03 when’
violations we,re again observed.
We arrived at 3:10 p.m.
There
is a mobile home on site and I knocked on the door, but
no
one answered.
I observed approximately 50 used vehicles, many unlicensed (see
photo #001
and #009).
Some were in a state ofdisrepair or partially dismantled, as seen
in photo #002 and #003.
Used tires were stacked and scattered around the site (see photo
#003 and photo
#005).
Scrap metal and used vehicleparts were also observed throughout
the site.
A pile of.pallets and lumberwas observed approximately 30’ by
25’
by 4’ (see
photo #006).
Other wood and lumber were scattered around (see photo
#004 and #009)
walking east, a pile about 40’ .by 20’ by
12’ ofrusted metal and vehicle parts was
observed .(see photo #007).
More abandoned vehicles were observed on the eastern part
ofthe property (see photo #008).
A semi trailer that I allowed Mr. Edwards to keep
during the last inspection was still
on site.
The sides ofthe trailer were bulging and split
and
appeared to be filled with lumber and
landscape waste.
We departed at 3:40 p.m.
