FACTS
1.
That Dale and
Carol Hartley are the present owners and operators of a facilityl-ocated
at
9535 IL HWY 133,
Pans, Edgar County,
Illinois.
The property is commonly known to the Illinois
Environmental
Protection Agency as
Paris/Hartley,
Dale & Carol.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with
Site Code
No. 0458010001.
3.
That Respondents have owned and operated said facility at all times pertinent hereto.
4.
That
on
February
16,
2005,
Curt
White
of
the
Illinois
Environmental
Protection
Agency’s
Champaign
Regional
Office
inspected
the
above~describedfacility.
A
copy
of
his
inspection
report
setting forth
the results
of said
inspection
is attached
hereto
and
made
a part
hereof.

VIOLATIONS
Based upon direct observations made by Curt White during the course of his February
16,
2005 inspection
of the
above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental-ProtectionTAct (hereinafter, the
“Act”) as follows:
(1)
That
Respondents caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section 21(p)(l) of
the Act, 415
ILCS 5/2l(p)(1)
(2002).

(2)
That
Respondents caused
or allowed
the open
dumping
of waste
in
a manner
resulting
in
opening
burning,
a
violation of Section
21(p)(3) of the Act, 415 ILCS
-
5/21 (p)(3) (2002).
CIVIL
PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2002),
Respondents are
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1 ,500.00)
for
each
of
the
violations identified above, fora total of Three Thousand
Dollars ($3,000.00).
If Respondents elect
notto petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and
payable
no
later than
April
30, 2005,
unless otherwise
provided
by order
of the
Illinois
Pollution
Control
Board.
If Respondents elect to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution
Control Board issues a finding of violation as alleged herein, after an adjudicatoryhearing,
Respondents shall be assessed the associated hearing costs incurred bythe Illinois Environmental
Protection Agency and the
Illinois Pollution Control Board.
Those hearing
costs shall be assessed

to
the One Thousand
Five
Hundred
Dollar ($1,500.00) statutory civil penalty for each
violation.

The weather conditions during this inspection were partly sunny and 35°F.
No interviews were
conducted during this inspection.
The initial inspection was conducted as a result ofa citizen
complaint.
The site is located at

IL.
Dale & Carol Hartley own the site.
The mailing
address is
the same as the site location.
The ownership was determined by going to the Edgar
County Supervisor ofAssessments Office in Paris,
IlL.
This inspection was conducted in accordance with Sections 4(c)
and (d) ofthe illinois
Environmental Protection Act
(“Act”). The purpose of this
inspection was to determine if the site
is in compliance with the Act
and Regulations.
SITE HISTORY
An Administrative Citation WarningNotice was sent to the above-mentioned site by certified mail
on December
1, 2004 and received by Carol Hartley on December 2, 2004
according to the U.S.
Postal
Service Mail Receipt.
No response was received from Dale &
Carol Hartley.

FEBRUARY 16, 2005 INSPECTION
FINDINGS
I arrived on the property at 10:25
am.
I walked around the property and I saw furniture, white
goods, a toilet and household waste scattered around the site and a 30’ x 27’ x
1’ burnpile
that
contained
ash, cans, furniture, metal and other wastes (see photos
1
thru 6).
The site had not been
cleaned up and the evidence at the site supported that open dumping and open burning continued
at
the site.
