HEARING OFFICER ORDER
On March 3, 2005, a telephonic status conference was held. Respondents Wooten
Construction, Ltd., and Smithfield Properties L.L.C., represented that they are proceeding with
discussions with their consultant and affected homeowners regarding an attempt to resolve this
matter. Wooten also represented that it will discuss options regarding remediation that may
include an interim settlement agreement. The complainant represented that it still anticipates a
settlement with the
Chicago Sun-Times Inc
., (
Sun-Times
). The
Sun-Times
did not appear at the
status conference.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on April 11, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
