HEARING OFFICER ORDER

On March 3, 2005, the complainant represented that the parties have reached a settlement

regarding the penalty demand and that it has drafted a stipulation and proposal for settlement

(stipulation) and will forward it to the respondent for its review. Due to the settlement status of

this matter, respondent’s answer is now due on or before May 27, 2005.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on May 5, 2005, at 9:00 a.m. The telephonic status

conference must be initiated by the complainant, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing. If, however, a stipulation is filed

prior to the next status conference, the conference will be cancelled without further order.
