Respondent,
Knox
County
Landfill
Committee,
is the permitted
owner and
operator of Knox County Landfill #3,
a facility located
in rural
Knox County, near Wataga,
Illinois.
2.
That
Respondent,
Greg
Ingle,
is the Certified Operator
of the above-referenced
facility.
3.
That
said
facility
is
operated
as
a
sanitary
landfill,
operating
under
Illinois
Environmental Protection Agency Permit No.
1994-1
05-LFM, and is designated with Site Code No.
.0958160003.
The facility is commonly known to the
Illinois
Environmental Protection Agency as
Knox County Landfill #3.

That Respondents
have owned
and/or operated
said facility at all times pertinent
hereto.

That on January21, 2005, Jeff Port of the Illinois Environmental Protection Agency’s
Peoria
Regional
Office
inspected
the
above-referenced
facility.
A copy of his
inspection
report
setting forth the results of said
inspection
is attached hereto and made a part hereof..
VIOLATIONS
Based upon direct observations made by Jeff Port during the course of his January 21, 2005
inspection
of
the
above-referenced
facility,
the
Illinois
Environmental
Protection
Agency
has
deterrilined that Respondents violated the
Illinois
Environmental
Protection Act
(hereinafter, the
“Act”)
as follows:
(1)
That Respondents cc~nducted
a sanitary landfill in a maririerwhkliresulted:Fnijncovered
refuse remaining from any previous operating day or:at the conclusion of any operating
day,
a violation of Section 21
(o)(5) of the Act, 415 ILCS 5/21
(o)(5) (2002).
CIVIL PENALTY
Pursuant to
Section
42(b)(4) of
the Act,
415
ILCS
5/42(b)(4)
(2002),
Respondents
are
subject
to
a
civil penalty of
Five
Hundred
Dollars
($500.00)
for
each
of the violations
identified
above, for a total of Five Hundred Dollars ($500.00).
If Respondents elect notto
petition the Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due:and:pay~b!e:no
iater
than
April
15, 2005,
unless otherwise
provided by order of the
Illinois Pollution
Control
Board.
If Respondents elect to contest this Administrative Citation~by
petitioning the Illinois Pollution
Control Board
in accordance with
Section 31.1
of the Act, 415 ILCS 5/31.1(2002),
and if the Illinois
Pollution Control
Board issues a finding of violation as afleged herein, afteran adjudicatoryhearing,

be assessed the associated hearing costs incurred by the Illinois Environmental

Those hearing costs shall be assessed
in addition
to the statutory civil penalty.

to petition or elect not to petition the Illinois Pollution Control
Board for review of this Administrative
Citation within thirty-five (35) days

which shall

this Administrative
Citation and
a
finding
of violation
as
alleged herein,

permits issued to the subject site and investigated into whether
or not required documents were timely tiled on behalf of the
subject site.

I
(Jeff Port)
performed
a
Solid
Waste Landfill Inspection
at the Knox
County Landfill #3 located in rural KnOx County, near Wataga.
The facility is
an 814 Subpart C
landfill with authorization
under
Permit
#1994-105-LFM issued
on
September 29,
1994..
The
most recent modification, #21
was issued on December 23, 2004.
I.arrived at the
site at
5:38
AM.
The entrance gate to
the facility was locked.

shows the locked gate.
At approximately
7:35 one
ofthe facility’s employees opened the exit
gate. I spoke with him briefly and he told me waste was being deposited in the new cell.
I then
proceeded
to
the
new
cell.

found

be
continuing
and

II. Operating Conditions

operator of this solid waste facility shall not conduct the operation
in
a
manner which results in any of the following.

refuse
remaining from
any
previous
operating
day
or at
the conclusion of any operating day, unless authorized by permit;
2.
Pursuant to Section
21(d)(2) of the
Illinois
Environmental
Protection
Act
(415
ILCS
5/21(d)(2)),
no
person
shall
conduct
any
waste-storage,
waste-treatment,
or
waste-
disposal
operation
in
violation
of
any
regulations
or
standards
adopted
by
the
Board
under this Act.
A violation of Section
21(d)(2)
is
alleged
for the

reason:

waste-disposal
operation in violation of Section 811.106(a) ofthe Regulations.
