HEARING OFFICER ORDER

On February 24, 2005, all parties participated in a telephonic status conference with the

hearing officer. The petitioner represented that it has forwarded a construction permit

application to install a recovery unit to the respondent. The respondent represented that it is

presently under review. Discussions have been ongoing.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on May 12, 2005, at 11:45 a.m. The telephonic status

conference must be initiated by the petitioner, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
