HEARING OFFICER ORDER
On February 23, 2005, a telephonic status conference was held. The respondent did not
appear. The petitioner informed the hearing officer that the related enforcement matter that is
also before the Board has been settled and that a stipulation and proposal for settlement
(stipulation) is being circulated for review. If the stipulation is approved in the related matter, it
intends to file a motion to voluntarily dismiss this matter. The petitioner represented that it will
file a 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on April 28, 2005, at 9:15 a.m. The status conference must
be initiated by the petitioner, but each party is nonetheless responsible for its own appearance.
At the status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing. If, however, a motion to voluntarily dismiss
this matter is filed prior to the next status conference, the conference will be cancelled without
further order.
