    ORDER OF THE BOARD (by G.T. Girard):
     
    On January 26, 2005, respondents filed a motion asking that the Board consolidate this
    proceeding with People v. Community Landfill Company, Inc., PCB 97-193. On February 2,
    2005, complainant filed a response indicating that complainant does not object to the
    consolidation of the two matters. Both parties believe that the consolidation of the two will
    avoid potential duplication and the parties will not be prejudiced (
    see
    Mot. at 2, and Resp. at 1).
     
    The Board is reluctant to consolidate this case filed in 2004 with a case filed in 1997.
    This is especially true because the Board has repeatedly ordered that the parties in PCB 97-193
    should proceed to hearing, expeditiously (
    see
    People v. Community Landfill Company, Inc.,
    PCB 97-193 (July 26, 2001) and People v. Community Landfill Company, Inc., PCB 97-193
    (Aug. 23, 2001); People v. Community Landfill Company, Inc., PCB 97-193 (Oct. 3, 2002);
    People v. Community Landfill Company, Inc., PCB 97-193 (Mar. 18, 2004). However, as both
    parties agree that consolidating these two proceedings will avoid duplication and that neither
    party will be prejudiced, the Board will grant the motion to consolidate these two proceedings.
