HEARING OFFICER ORDER
On February 17, 2005, the parties participated in a telephone status conference with the
hearing officer. It appears unlikely that the parties will agree on the issue of compliance
certification wherein respondent wants petitioner to agree to comply with any future regulatory
changes that may occur before the permit period expires. Before setting this matter for hearing,
the parties are working to resolve other issues.
The parties are directed to participate in a telephone status conference with the hearing
officer at 11:00 a.m. on March 17, 2005. To attend the telephone status conference, please call

discuss the status of this matter.
Petitioner filed an open waiver of the statutory decision deadline in this matter.
