HEARING OFFICER ORDER
On February 7 and 8, 2005, telephonic pre-hearing conferences were held. The parties
represented that no witnesses will be called at the hearing scheduled for February 10 and 11,
2005. Instead, the parties will discuss on the record their intention to file briefs citing to the
record in this matter pursuant to an agreed upon briefing schedule. The agreed briefing schedule
is as follows. Simultaneous opening briefs are due to be filed on or before February 28, 2005,
and simultaneous reply briefs are due to be filed on or before March 7, 2005. The mailbox rule
will not apply to either the filing with the Board or to each of the respective parties.
