FACTS

That Judy Cornelison (“Respondent”) isthe present ownerof a facility located at 7927
S.
McCumber Road, Peoria County, Peoria, Illinois.
The property is commonlyknown to the
Illinois
Environmental Protection Agency as Cornelison,
Judy.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and
is designated with Site Code No.
1438055004.
3.
That Respondent has owned
said facility at all times pertinent hereto.
4.
That on
January 4, 2005,
R.
Eugene Figge of the Illinois Environmental
Protection
Agency’s Peoria
Regional
Office inspected
the above-described facility.
A copy of his inspection
report setting forth
the results
of said.inspection is attached
hereto and
made a part hereof.

VIOLATIONS
Based upon direct observations made by R. Eugene Figge during the course of his January
4,
2005 inspection
of the above-named
facility, the
Illinois Environmental
Protection Agency has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or allowed
the open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act, 415
ILCS
5/21(p)(1)
(2002).
CIVIL
PENALTY
Pursuant to
Section
42(b)(4-5)
of the Act,
415
ILCS
5/42(b)(4-5)
(2002),
Respondent
is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dol!ars
($1,500.00) for
each~o~
the
violations
identified
above,
for a
total of
One Thousand
Five
Hundred
Dollars
($1,500.00).
If
Respondent elects
not
to
petition
the
Illinois
Pollution
Control
BOard,
the statutory
civil penalty
specified above shall be due and payable no later than March 30,2005, unless otherwise provided
by order of the Illinois
Pollution Control
Board.

On January 4,
2005 an inspection was conducted from 9:00 a.m. until 9:20
a.m. at Comelison,
Judyby R.
Eugene Figge (this author) ofDLPC/FOS
-
Peoria.
A signed Consensual Removal
Agreement has been received by the Agency.
The waste tires on the site will be removed when
the
open dump is cleaned up.
On the site the author observed that the property remained in the same condition it had been in
during the October
5,
2004 inspection.
Part ofthe tires had been removed from the ravine and
staged and part ofthe other waste had been removed.

is alleged for the following reason: Evidence of open dumping ofwaste was
observed during the inspection that indicated Judy Cornelison as owner had caused
or allowed open dumping.
