HEARING OFFICER ORDER
On February 7, 2005, all parties participated in a telephonic status conference with the
hearing officer. Briefing schedules were discussed regarding the petitioners’ motion for
summary judgment filed on February 4, 2005. To that end, it was agreed that the respondents’
response or other pleading is due to be filed on or before March 21, 2005. The respondents
represented that they may file a motion to stay the response to the summary judgment pending
the Board’s decision of the various motions regarding scope of discovery that are presently
before it. Petitioners’ reply is due to be filed on or before April 1, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on April 28, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
