FACTS
1.
That Patrick O’Keefe (“Respondent”) operates a business, Falcon Bobcat Servies
within Sangamon County, Illinois.
2.
That after a bidding process, Sangamon County Department ofPublic Health did
award the Respondent a contract to demolish
a dangerous structure located at
11548 Main Street,
Glenarm, Illinois.
3.
That on November 3, 2004 a contract was signed outlining the provisions ofthe
demolition.
4.
That on December 29, 2004
at approximately 1:05 pm, the Divernon Fire
Department was dispatched to
11458 Main Street, Glenarm, Illinois, on the report of a fire.
Upon arrival at the scene, the officer in charge saw shingles, and siding in the fire pile.

5.
At that time the officer in charged talked with the Respondent.
Advised the
respondent not to burn any shingle, siding or asbestos items.
6.
That on December 29, 2004 at approximately 4:24 pm, the Divemon Fire
Department was dispatched to
11458
Main Street, Glenarm, Illinois on the report of a second
fire.
Upon arrival at the scene they observed a fire in progress.
The burning pile contained
siding, mattresses, chairs, bottles, and various household goods~

That when Officer B. Helton from the Sangamon County
Sheriff’s Office spoke
with the Respondent, the Respondent acknowledge starting the fire.

That on December 29, 2004, Adam Proctor of the Sangamon County Department of
Public Health (“SCDPH”) inspected the above-described property based on a complaint
VIOLATIONS
Based upon direct observations made by
Adam Proctor during the course of his
December 29, 2004
inspection ofRespondent’s property, the County of Sangamon has
determined that Respondent has violated the Act as follows:
1.
That Respondent caused or allowed the open dumping of waste in a maimer
resulting in open burning, a violation of Section 2l(p)(3) of the Act, 415 ILCS 5/21(p)(3)
(2002).
2.
That Respondent caused or allowed the deposition of (i) general construction or
demolition debris as defined in Section 3.160 of the Act, 415
ILCS 5/3.160 (2002), or (ii) clean
construction or demolition debris as defined in Section 3.160(a) ofthe Act, 415 ILCS
5/3.160(a)
(2002), a violation of Section
2l(p)(’7) ofthe Act, 415 ILCS 5/2l(p)(7) (2002).

CIVIL PENALTY
Pursuant to
Section
42(b)(4-5)

Act,

(2002), Respondent
is
subj ect to a civil penalty of One Thousand Five HundredDollars
($1 ,500.O0) for each of the
violations identified above, for a total of Three Thousand Dollars ($3,000.00).
IfRespondent
elects not to petition the Illinois Pollution Control Board, the statutory civil penalty
specified
above shall be due and payable no later than March
5.
2005,
unless otherwise provided by
order of the Illinois Pollution Control Board.
IfRespondent elects
to contest this Administrative Citation by petitioning the Illinois
Pollution Control Board in accordance with Section
31.1 of the Act, 415
ILCS 5/31.1
(2002), and
if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an
adjudicatory hearing, Respondent shall be assessed the associated hearing costs incurred by the
County ofSangamon and the Illinois Pollution Control Board.
Those hearing costs shall be
assessed in addition to the One Thousand Five Hundred Dollar
($1,500.00)
statutory civil penalty
for each violation.
Pursuant to Section
31.1(d)(1) ofthe Act, 415
ILCS
5/31.1(d)(1) (2002), if Respondent
fails to petition or elects not to petition the Illinois Pollution Control Board for review of this
Administrative Citation within thirty-five (35) days ofthe date ofservice, the Illinois Pollution
Control Board shall adopt a final order, which shall include this Administrative Citation and
findings ofviolation
as alleged herein, and shall impose the statutory civil penalty specified
above.

When payment is made, Respondent’s check shall be made payable to the Sangamon
County Department of Public Health and mailed to
the attention ofJames D.
Stone, Director of
the Sangamon County Department of Public Health, 2501 North Dirksen Parkway, Springfield,
Illinois 62702.
Along with payment, Respondent shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty and/or hearing costs are not paid within the time prescribed by order ofthe
Illinois Pollution Control Board,
interest on said penalty and/or hearing costs shall be assessed
against Respondent from the date payment is
due up to
and including the date that payment is
received.
The State’s Attorney ofSangarnon County may be requested to initiate proceedings
against Respondent in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.
In addition to the previously assessed civil penalty and/or hearing costs and/or interest,
the State’s Attorney of Sangamon County will seek to recover his costs oflitigation.

complaint

Adam
Proctor
who
works
for
the
Simgamon
county
public
health
department.
The
complaint
was
about
a
contract
between
Sangamon
county
department
of
public
health
and
Patrick
A.
O’Keefe
(WIN1

Adam
advised
that
Patrick
was
awarded
a
contraCt
to
demolish
and
haul
away
the
residence
at
12048
Main,
Glenarm,
IL
because
the
residence
is
unsafe
for
habitat.
Adam
advised
that
he
received
a
call
from
the
Cliatham
fire
department
about
Patrick
illegalLy
burning
items
inside
the
residence
and
pieces
of
the
demolished
residence.
Adam
advised
that
the
contract
between
the
public
health
and
Patrick
does
not
allow
km
to
burn
any
(If

solid
waste
and
that
all
the
materials
are
to
be
hauled
to
the
Sangainon
county
dwnp
free
of
cost
to
Patrick.

burning
a
large
pile
of
wood
and
debris
from
the
residence.
Divernon

arrived
on
scene
and
put
the
fire
out.
Adam
also
arrived
on
scene
and
began
looking
through
the
debris
after
the
fire
was
out.
Adam

advised
that
there
were
the
remains
of
a
mattress,
plastic
bottles,
wood,
and
siding
that
contained
asbestos.
Adam
took
digital
pictures
of
the
~
debris
and
advised
that
he
would
keep
custody
of
the
pictures.
Since
Adam
took
the
pictures-I
did
not
call
for
an
ID
tech
to
take
pictures
of
the
w
debris.
I
spoke
with
Patrick
and
he
advised
that
he
had
in
fact
been
awarded
the
contract
for
demolishing
the
residence.
Patrick
advised
that
the
contract
did
not
state
anything
about
not
being
able
to
burn
anything.
Patrick
advised
that
the
only
thing
that
he
was
burning
WflS
pieces
of
wood
and
lumber
from
the
residence
and
was
not
burning
anything
illegal.
Patrick
advised
that
Deputy
I.
Gillette
had
advised
him
that
he
could
burn
wood
because
it
was
not
incorporated.
