Environmental Protection Agency by

FACTS
1. The Respondent, Southern Illinois Regional Landfill, Inc. (hereinafterreferred to as the
Landfill)(Site Code 0770200002), is a sanitary landfill facility located and operating in Jackson
County, Illinois, having a State operating permit number 1994-176-LF, expiringNovember 1, 2005.
2. The Respondent, Doug Ticer, for all relevant times hereto, is and has been a certified
landfill operator for the Landfill; and residing at 123 U.S. Route 51N, DuQuoin, County ofPerry,
Illinois.
3. The Respondent, George Browning, forall relevanttimes hereto,is and hasbeen acertified
—
landfill operator forthe Landfill; and residing at 112 California, Carterville, County ofWilliamson,
Illinois.
4. The Landfill hasowned, operated, occupied, and controlled the facility at all relevant times
hereto.

On December 9, 2004, Don Terry, Solid Waste Inspector, Jackson County Health
Department, inspected the facility. A true and correct copy ofthe inspection report, along with Mr.
Terry’s affidavit, are attached and incorporated herein by reference as Exhibit A.
VIOLATIONS
On the basis ofSolid WasteInspector, Don Terry’s, direct observation,he hasdetermined that
the Respondents have caused orallowed at the above facilityin a mannerthat resulted inthe following
violations:
1. Uncovered refuse to remain from any previous operating day or at the conclusion ofany
operating day in violation of415 ILCS
5/21(o)(5);
and
2. Failing to collect and contain litter by the end ofeach operating day in violation of 415
ILCS
5/21(o)(12).
CIVIL PENALTY
In accordance with 415 JLCS 5/42 (b)(4), the Respondents are subject to a civil penalty of
$500.00 for each ofthe violations specified above. Additionally, should the Respondents elect to
petition the Illinois Pollution Control Board under the review process described below, after an
adjudicatory hearing, the Respondents shall be assessed the hearing costs incurred by the Pollution
Control Board. The hearing cost would be in addition to the $1,000.00 fine.
If you acknowledge the violations cited herein above, the civil penalty shall be due and
payable no later than Mayl, 2005. Ifyoudo not petitionthe Pollution Control Board for review of
the Administrative Citation within 35 days ofservice ofthe Administrative Citation, or contest the
Citation, anyjudgment that maybe renderedagainst you shall specify the due dateofthe civil fme and
any additional costs assessed against you.

Whenpayment is made, yourcheckshould be madepayable to the JacksonCounty’s Treasurer
Office and mailed to the attention of Shirley Dillinger Booker, Jackson County Treasurer,
Murphysboro, Illinois, 62966. Also, please completeand return the enclosedremittance form, along
with your payment, to assure proper credit.
Ifany civil penalty is not paidwithin the prescribedtime, the lawallows forthe accumulation
and payment ofinterest on the remaining unpaid balance. If any civil penalty is not paid when due,
the Office ofthe State’sAttorney shall be requestedto initiateproceedingsin Circuit Court to collect
the penalty. In addition to the civil penalty, hearing costs, and interest, if any, the Jackson County
State’s Attorney may seek to recover their costs oflitigation.

AflIant is a field inspector employed by Jackson County Health Department and
has been so employed at all times pertinent hereto.

On December 9, 2004, between the hours of6:23 am and 11:15 am, Affiant
conducted an inspection ofthe IEPA permitted sanitary landfill known as
DeSoto/SIRLI, Jackson County, Illinois.
3.
Afflant inspected said IEPA permitted sanitary landfill by an on-site inspection.
4.
As a result ofthe activities referred to in Paragraphs 2 and 3 above, Afilant
completed the Inspection Report form attached hereto and made a part hereof,
which, to the best ofAffiant’s knowledge and belief, is an accurate representation

GENERAL REMARKS
During the above
date and time, I conducted an inspection of Southern Illinois Regional
Landfihl, Inc. Weather conditions during the inspection were: a temperature of 45°F;partly
cloudy with moderate winds from the
southeast.
I was accompanied on this inspection by Kevin Gillespie, Director of
Environmental Health at
the Jackson County Health
Department. As
I drove in the gate, I observed four transfer trailer
trucks and two compactor trucks waiting in line. The office did not appear open at my arrival, so
I proceeded to the active
face located in Phase I
(Photos #1—
#3,
see Phase
I
sketch; GPS N
37°50.323W 089°15.685). Trucks were
not depositing waste at the active face when I arrived.
I observed that the portable lighting system was on, illuminating the tipper and active face area.
I also observed that the landfill gas flare was burning.
I walked to the tipperwhere I observed a bulldozer moving in an area south of it. Upon closer
inspection, it appeared to be preparing the active face for the day.
I walked down the south slope of Phase I. Atapproximately 6:47 am, I observed trucks begin to
arrive and deposit waste

I
observed the
tipper operating, the bulldozer moving waste into the active face and the compactor moving and
compacting the waste. I observed the compactor moving and compacting waste downhill.
Given that the active face was located on an outer slope, this method appeared appropriate.
Southwest of the active face, I observed an area of exposed waste (Photo #4, Phase I sketch).
This area was approximately 30 feet by 30 feet in size.
I walkedwest along the south slope of Phase 1, above the upper, boundary of the Phase I
closure area and below the upper lift. Approximately 100 feet west of the active face, I detected
a sound similar to the sound made when air is bubbled through a liquid. The sound was
coming from a hole in the side slope of Phase
I (GPS N 37°50.323W 089°15.685). I
observed

bubbling through leachate within the hole

rapid and non-stop, which indicated to me that the landfill gas was under pressure. The hole
was approximately six inches in diameter and I observed a leachate pool lying adjacent to it

I sketch). Approximately 10 feet west of this leachate outbreak, I observed
two smaller leachate outbreaks.

west along
the south slope. Near the
southwest corner

observed another
Ieachate outbreak (Photo #6, Phase I sketch; GPS N 37°50.332W 089°15..792). This
outbreak was
located below
the
upper
lift and above the
upper boundary
of the
Phase
I
closure
area. It was approximately 2.5 feet long. The soil where the leachate had flowed was a
reddish-brown in
color
(Photo #6, Phase I sketch) and I detected an odor associated with
landfill
gas
near this location.
I walked north and. down the slope to the bench on the upper boundary of the Phase I closure
area. I observed an area of leachate outbreaks north of the outbreak noted above (Photos #7
& #8, Phase I sketch; GPS N 37°50.354W 089°15.792). I observed three leachate flows
approximately six feet long in this area. I observed that these flows were pooling on the bench
above the Phase I closure area (Photo #8, Phase I sketch).
I then walked down the western outer slope of Phase Ito a leachate manhole (Photos #9 - #11,
Phase I sketch). I observed a Ieachate outbreak near the southeast edge of this manhole
(Photos #9 & #10, Phase I sketch). The outbreak begin approximately three feet east of the
manhole. I observed that some of the soil in the path of the flow had a reddish-brown color. An
odor associated with landfill gas was detectable in this area.
Approximately 40 feet north of above mentioned leachate manhole, I observed another
leachate flow (Photo #12, Phase I sketch). The flow originated at a location indicted by the
right foot of the individual shown in Photo #12. This flow is located approximately 15 feet
outside ofthe waste footprint, indicated by the white post seen in the background of Photo
#12.
I walked north where I observed a ground water monitoring well designated GI9S. Water was
pooling in a low spot, and within 6 inches of the northern base of the well casing. I later
explained my observation to Mr. Ticer who stated that he would see that the low spot was built
up with
soil
as soon as possible.
I walked north to a leachate manhole at the northwest corner of Phase I, where I had observed
leachate outbreaks on previous inspections (See Phase I sketch). During this inspection I
observed several leachate flows in this area (Photos #13 —
#17, Phase I sketch; GPS N
37°50.418 W 089°15.830).
Southwest ofthe leachate manhole, I observed a leachate flow approximately thre
feet
wide
‘and’
25’feet long. I observed the liquid had an oily-sheen to it, but detected no odors near the
flow. The flow originated at a spot indicated by the left foot of the individual shown in Photo
#13. This location is outside of the Phase I waste footprint. I observed the flow moving
downhill towards a storm water retention pond (Photos #13 & #14, Phase I sketch). I followed
the flow towards the storm water retention pond and observed no evidence that the flow had
reached the water. Even though the leachate had not entered the pond, it was threatening to
do so.

Southeast ofthe leachate manhole, I observed an area which was deeply eroded (Photo #15,
Phase I sketch). This area was observed on previous inspections and reported to SIRLI
personnel. Approximately 12 feet east of this deep rut, I observed a second leachate flow
(Photos #16 & #17, Phase I sketch). The flow originated at a spot indicated by the right foot
of the individual shown in Photo #16.
The flow followed an erosion cut down hill towards the same storm water retention pond (Photo
#17, Phase I sketch). I walked to the pond where the erosion cuts emptied into the pond, but
did not observe evidence that leachate had entered the water. The leachate flow is threatening
to enter the pond due to its location up hill from the water.
I walked up the north outer slope of Phase I. At the active face, I observed a roll off container
being emptied. I went to the waste pile left by the roll off and observed that it had contained
household and C/D waste. I observed nothing in the load which was prohibited at SIRLI.
I went to the liquid waste solidification area on the eastern end of Phase I. I observed that the
area was free of litter and exposed waste and in general compliance.
I drove to the south end of Phase II. I observed an area approximately .25 acres in size at the
southern end of Phase II which was below the grade of the upper lift (Photo #19, Phase II
sketch).
I observed exposed waste in this area (Photo #19, Phase II sketch). Later in the
inspection, Mr. Ticer, SIRLI’s Certified Operator explained that the low area observed at the
southern end of Phase II had remaining air space and would be filled with waste from
compactor trucks until maximum capacity had been achieved. He stated that the tipper had
been moved from Phase II to Phase I on Saturday, December 4, 2004. He went on to say that
the only waste placement activities on Phase II had been from compactor trucks on Monday
and Tuesday, December 6 and 7, 2004.
I walked to the upper lift of Phase II and observed the west outer slope. From my location I
observed wind blown lifter and exposed waste over much of the west outer slope of Phase II
(Photo #20, Phase II
sketch).

I proceeded northeast on the upper lift of Phase II. Over the entire upper lift of Phase II I
observed exposed waste and wind blown litter (Photos #21, #22, #26, #27 & #28, Phase II

At the north end of the upper lift of Phase II I observed the tan tarp used by SIRLI as alternate
daily cover (ADC) on occasion (Photo #21, Phase II sketch). Mr. Ticer later explained that this
cover had not been moved to Phase I. Later in the inspection, a review of ADC records
confirmed that this had not been used recently as ADC.
I walked to the eastern outer slope of Phase II where I observed exposed waste and wind blown
lifter on the slope (Photos #23 —
#25,
Phase II sketch). I did observe two individuals
beginning to pick up the litter at approximately 9:23 am, the time Photo #25 was taken.

I proceeded to the western outer slope of Phase II and observed that the northern end of this
outer slope contained exposed waste and wind blown litter (Photo #29, Phase II sketch).
I drove to the South Unit Expansion area. The area appeared to be in general compliance. I
observed the southern leachate manhole, where I had observed an uncapped pipe within the
manhole on my November 4, 2004 inspection had a three foot extension added and the cover
was bolted secure. A pipe extended up out of the cover. A cap was secured to the pipe with
two band straps (Photo #30, Phase II sketch). The appearance of this manhole today appears
to coincide with the description given to me on the November 4, 2004 of its planned
modification.
I drove to the SIRLI container storage yard and checked several containers for waste. The
area appeared to be in general compliance.
I returned tO the office of Mr.’ Ticer where I reviewed written records for ADC, load checking,
leachate re-circulation. All records appeared up to date and in order. I then went to the scale
house to review recent special waste manifests. All records I checked appeared to have the
required information. Before leaving, I informed Mr. Ticer of the violations I had observed on
today’s inspection.
My inspection ended at approximately 11:15 am.
