HEARING OFFICER ORDER

On January 13, 2005, all parties participated in a telephonic status conference with the

hearing officer. The petitioner represented that it will resubmit some documents so that the

respondent may formally approve the settlement. The petitioner represented that it will file a

120-day waiver of the statutory decision deadline.

The parties are directed to participate in a telephonic status conference with the hearing

officer on March 10, 2005, at 11:15 a.m. The status conference must be initiated by the

petitioner, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matter and

their readiness for hearing. If, however, a motion to voluntarily dismiss is filed prior to the next

status conference, the conference will be cancelled without further order.
