HEARING OFFICER ORDER
On January 11, 2005, the petitioner informed the hearing officer that the related
enforcement matter that is also before the Board has been settled and that a stipulation and
proposal for settlement (stipulation) is being circulated for review, and that it has received a draft
permit from the respondent in this matter that it will review. If accepted, it intends to file a
motion to voluntarily dismiss this matter.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on February 23, 2005, at 9:00 a.m. The status conference
must be initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing. If, however, a stipulation is filed prior to
the next status conference, the conference will be cancelled without further order.
