HEARING OFFICER ORDER

On January 4, 2005, the parties participated in a telephone status conference with the

hearing officer. The parties believe that the problem with the written confirmation of the

settlement agreement will be resolved by the next status conference.

The parties are directed to participate in a telephone status conference with the hearing

officer at 3:00 p.m. on January 18, 2005. The call shall be initiated by the petitioner.

Petitioner has filed an open waiver of the statutory decision deadline.
