HEARING OFFICER ORDER
On December 20, 2004, all parties participated in a telephonic status conference with the
hearing officer. The respondent’s attorney represented that its client has filed for bankruptcy and
before a stipulation and proposal for settlement (stipulation) is agreed to, she must be approved
by a board of creditors. The attorney has now been approved and represented that settlement
proceedings are progressing. The parties remain optimistic, however, that a stipulation will be
filed eventually. By agreement, the respondent’s answer is now due on or before April 4, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on March 3, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
