the Illinois
EPA issued
a final decision to
the Petitioner.

2004,
the Petitioner made a written request to
the Illinois
EPA
for an
extension of time
by which
to
file a petition for review,
asking the Illinois
EPA join in
requesting that
the Board
extend
the thirty-five day period
for filing
a
petition
to
ninety
days.
The copy of the final decision provided by
the Petitioner
contains a “Received Nov.

2004”
stamp.

The application for payment covers the period from January

2002 to February 29, 2004.
The amount requested is $52,033.47.
The deductible amount for this
claim is $15,000.00, which was previously deducted
from the
billing submittal received by the Agency on
August 22, 2001
in the amount of $3,543.50 and
September 7,2001
in
the amount of$148,451.40.
There are costs
from this claim that are not
being paid.

in Attachment A are the costs that are not being paid and the reasons these
costs are not being paid.
On September 20, 2004, the Agency received your complete application for payment for this
claim.
As a result ofthe Agency’s review ofthis application for payment,

will be prepared for submission

the Comptroller’s Office for payment as funds
become available based
