ERRATA SHEET OF THE ILLINOIS ENVIRONEMNTAL PROTECTION AGENCY
NOW COMES the Illinois Environmental Protection Agency (“Illinois EPA”), by
and through its
attorney Kyle Rominger, and submits this errata sheet in the above
referenced proceeding.
The following are suggested changes to the rules printed in the
Board’s Order for First Notice dated November 4, 2004.
1.
Due to
the addition ofSection 703.
123(h)(5),
in the first sentence of
Section 703.123(h) the Illinois EPA proposed changing the reference to
subsection
“(h)(4)” to
“(h)(5)”.
This change proved easy to overlook due to
the masking ofthe
strikethrough line by the cross line in the number “4”.
In the Board’s Second Notice the
Illinois EPA suggests proposing the change as follows
so it more easily catches the
reader’s eye.

A universal waste handler or universal waste transporter (as
defined in 35
Ill. Adm. Code
720.110) that manages the wastes
listed in subsections (h)(1) through
(h)(5)(h)(4)
ofthis Section.
Such a handler or transporter is
subject to regulation under 35
Ill.
Adm. Code 733.

In Section 721.109, there is
a comma missing in the citations listed
in the
first
sentence.
The first sentence should be amended as follows so there is a comma
between “702” and “703”:

Code 702~703, 722 through 726, and 728, except as specified in 35

Adm. Code 733, and are therefore not fully regulated as hazardous
waste.

The reference to Section 733.106 in proposed Section 725.101(c)(14)(E)
includes “I..” instead of“Ill.”
Proposed Section 725.101 (c)(1 4)(E) should read as
follows:

Section 728.101(a) is underlined, indicating that the Section is new.
This
Section should not be underlined.
It is existing language
and no changes to Section
