ORDER OF THE BOARD (by C.A. Manning):
On September 17, 1998, the Board entered a default order in this action, noting that no
petition for review had been filed. The Board subsequently discovered that the order had been
prematurely entered due to an error in docketing the final date of the 35-day period during
which a petition for review could be filed. Under Section 31.1(d)(1) of the Environmental
Protection Act (415 ILCS 5/31.1(d)(1) (1996)), no default order should have been entered
prior to October 6, 1998.
On October 5, 1998, the Board received a petition for review from the respondent.
The Board accordingly vacates the September 17, 1998 default order and accepts this petition
for review. A hearing officer will be assigned, who will contact the parties to set a date for
hearing.
