HEARING OFFICER ORDER
On December 13, 2004, all parties participated in a telephonic status conference with the
hearing officer. The respondent made an oral motion for an extension of time to file its
recommendation in this matter. The petitioner had no objection. Respondent’s motion is
granted and its recommendation is now due to be filed on or before January 10, 2005. The
parties represented that discussions continue and that informal discovery has been proceeding.
The petitioner requested that a hearing date be scheduled. To that end, it was agreed that
a hearing be scheduled for February 24, 2005. The time and place will be noticed in the notice
of hearing. Petitioner represented that it will file a waiver of the statutory decision deadline to
April 21, 2005.
The parties or their legal representatives are directed to participate in a telephonic pre-
hearing conference with the hearing officer on January 27, 2005, at 9:30 a.m. The telephonic
pre-hearing conference must be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the conference, the parties must be prepared to discuss
the status of the above-captioned matter and their readiness for hearing.
