HEARING OFFICER ORDER
On December 2, 2004, all parties participated in a telephonic status conference with the
hearing officer. The petitioners represented that the underlying enforcement matter has been
settled and that a consent decree has been entered. The petitioners are completing a series of
requirements that is mandated by the consent decree. Once completed, the petitioners anticipate
that they will be filing a motion for voluntary dismissal for the above-captioned matters once a
revised permit is approved. The petitioners represented that they will file a waiver of the
statutory decision deadline to and including May 19, 2005.
The parties are directed to participate in a telephonic status conference with the hearing
officer on January 27, 2005, at 11:30 a.m. The status conference must be initiated by the
petitioners, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matters and
their readiness for hearing. If, however, motions to dismiss the respective matters are filed prior
to the next status conference, the conference will be cancelled without further order.
