ORDER OF THE BOARD (by J.P. Novak):
On June 28, 2004, the Illinois Environmental Protection Agency (Agency) timely filed
three separate administrative citations against Earl and Norma Martin (respondents).

ILCS 5/31.1(c) (2002); 35 Ill. Adm. Code 108.202(c). Each administrative citation involves a
separate inspection date at a single location at County Road 2500 North, Rio Township, Knox
County. Each administrative citation contains similar, but distinct, allegations.
On November 18, 2004, the Agency filed a motion to consolidate the administrative
citations for the purpose of hearing. The Agency asserts in support of its motion that (1) the
property and parties are the same; (2) the Agency’s main witnesses and burdens of proof are
identical; (3) consolidation for the purposes of hearing would add to the interest in a convenient,
expeditious; and complete determination of the issues; and (4) consolidation would cause no
material prejudice. The Board grants that motion and consolidates the administrative citations
for hearing.
