HEARING OFFICER ORDER

On November 30, 2004, the parties contacted the hearing officer separately regarding this

matter. According to respondent’s attorney, the technical units are still working out the

mechanics for petitioner’s site clean-up plan. Once the plan is in place, petitioner will dismiss

this appeal.

The parties are directed to participate in a telephone status conference with the hearing

officer at 9:30 a.m. on February 1, 2005. The telephone status conference will be initiated by the

petitioner. At the status conference, the parties must be prepared to discuss the status of the

above-captioned matter.

The petitioner has filed an open waiver of the decision deadline in this matter.
