    HEARING OFFICER ORDER
     
    On November 30, 2004, the parties participated in a telephone status conference with the
    hearing officer. Respondent has approved the ELUC (Environmental Land Use Covenant), and
    will send a draft to petitioner. If petitioner has no comments, respondent will issue a letter
    indicating that no further remediation is needed. Respondent hopes to get this done before the
    end of the year. At the next status conference petitioner must be prepared to file an additional
    waiver of the decision deadline.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 2:00 p.m. on January 4, 2005. The status conference shall be initiated by the petitioner.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
     
    The decision deadline is currently April 7, 2005.
