    HEARING REPORT
     
     
    On November 22, 2004, a hearing in this matter was held at the Jackson County Health
    Department in Murphysboro, Illinois. Attorney Daniel Brenner appeared on behalf of
    complainant. Attorney Gregory Veach appeared on behalf of respondent.
      
    Witness Credibility
     
     
    Six witnesses testified during the hearing:

    Mr. Egon Kamarasy
    Mr. Archie Mays
    Mr. Phillip McMurphy
    Mr. James Taylor
    Mr. Kerry Grunloh
     
      
      
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.
    Exhibits
     
    The complainant and respondent offered exhibits as evidence at hearing. Complainant’s
    Exhibit 1 consists of Mr. Terry’s inspection reports for both sites. For AC 04-63, respondent’s
    Exhibits 1-5 are attached to the back of his brief submitted at hearing. These exhibits consist of
    letters from the Department of Public Health, a site sketch, and an invoice for work performed at
    the site. For AC 04-64, respondent’s Exhibit 1 is a receipt for work performed at the site. There
    were no objections to any exhibits offered, and all exhibits were admitted into the record.

    The transcript is due December 6, 2004. Complainant will file its brief by January 10, 2005.
    Respondent filed a brief at hearing, but may respond to complainant’s brief by February 10,
    2005. Complainant’s reply, if any, is due February 28, 2005.
