HEARING OFFICER ORDER
On November 18, 2004, a telephonic status conference was held. Respondent did not
appear. The complainant represented that the Illinois Environmental Protection Agency has
approved two of the three supplemental environmental projects offered by the respondent and
that the penalty demand remains at issue.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 20, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
