HEARING OFFICER ORDER
On November 18, 2004, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that a draft stipulation and proposal for
settlement (stipulation) is being reviewed internally and will be forwarded to the respondent for
review when completed. Both parties are somewhat optimistic that a settlement will be reached.
By agreement, respondent is given to February 21, 2005, to replead its affirmative defense to
laches
, if needed, and the complainant is given to February 21, 2005, to answer respondent’s
affirmative defense number 2 not addressed in the Board order of March 4, 2004, if needed.
The parties are directed to participate in a telephonic status conference with the hearing
officer on January 19, 2005, at 10:00 a.m. The status conference must be initiated by the
complainant, but each party is nonetheless responsible for their own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a stipulation is filed prior to the next status conference,
the conference will be cancelled without further order.
