    HEARING OFFICER ORDER

On November 17, 2004, the parties participated in a telephone status conference with the
hearing officer. Petitioner continues to report progress on the development of a new a regional
water treatment facility in Shelbyville, Illinois. This regional treatment center would process
sewage for petitioner, and would result in petitioner’s withdrawal of this permit appeal. The
preliminary engineering report has been approved, and the project engineers plan to complete the
final design details during the winter months. Hopefully, construction will begin next spring.
Some delays have stemmed from the expansion of this project to now include Eagle Creek State
Park, the Findley marina, and a new lift station.

The parties are directed to participate in a telephone status conference with the hearing
officer at 8:45 a.m. on May 26, 2005. The status conference shall be initiated by the petitioner.
At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.

There is an open waiver of the decision deadline in this docket.

    IT IS SO ORDERED.
