    HEARING OFFICER ORDER
     
    On November 16, 2004, the parties participated in a telephone status conference with the
    hearing officer. The parties are waiting for the Office of the State Fire Marshall (OSFM) to issue
    a determination of eligibility. Respondent will amend its decision based on OSFM’s
    determination, at which point petitioner will withdraw this appeal.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on January 18, 2005. The status conference shall be initiated by the
    petitioner.
     
    There is an open waiver of the decision deadline in this matter.
