    HEARING OFFICER ORDER
     
    On November 16, 2004, petitioner participated in a telephone status conference with the
    hearing officer. Respondent did not appear. Petitioner recently began its work on the closure
    plan, having recently acquired the necessary personnel. Petitioner plans to present the closure to
    the circuit court in Lawrence county in March, 2005 (rescheduled from November 2004). Once
    a closure plan is in place, petitioner may be able to dismiss this appeal.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:00 a.m. on April 5, 2005. The status conference shall be initiated by the petitioner.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
     
    Petitioner has filed an open waiver of the decision deadline in this matter.
