HEARING OFFICER ORDER
On November 9, 2004, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it has filed for bankruptcy and before a
stipulation and proposal for settlement (stipulation) is agreed to, it must be approved by a board
of creditors. The respondent represented that the proceedings are progressing. The parties
remain optimistic, however, that a stipulation will be filed eventually. By agreement, the
respondent’s answer is now due on or before January 28, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 20, 2004, at 10:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
