HEARING OFFICER ORDER
On November 9, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they have reached a settlement on the penalty
demand and that complainant will draft a stipulation and proposal for settlement (stipulation) and
forward it to the respondent for its review. By agreement, the respondent’s answer due date was
extended. The respondent’s answer is now due to be filed on or before February 2, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 13, 2005, at 10:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a stipulation is filed
prior to the next status conference, the conference will be cancelled without further order.
