the Illinois Environmental Protection Agency (Agency) filed a~
proposal for rulemakingpursuant to Sections
27 and 28
of Environmental Protection Act (Act)

The Agency proposes to amend the
Board’s rules governing the standards for universal waste management found in the Board’s
existing rules at 35 Ill.

Public Act 93-964 became effective on. Aug
st20, 2004.
The Agency was required to
propose‘with n. 60 days of the effective date ofPublic Act
93-964, rules that designate mercury
switches; rnercury’~relays,and scientific instruments and instructional equipment containing
mercury added during theirmanufacture as universal waste.
The Board is required to adopt the
rules on or before April
15,
2005,
Due to the stringent timeframe for final adoption, the Board s&
forth a specific titheframe
forproceeding with this rule.
To
ensure that. the Board completes the rulemaking in that
timeframe, the. comment period for this rulemaking will close by January 20, 2005.
The Board
will ask for an expedited transcript from thehearing to he held on January 6, 2005
Both
hearings will be conducted to allow the Agency and all other interested parties the opportunity to
present testimony on the proposed rules.
The order ofthe first hearingwill be:

2.
Testimony by the Agency; and
3.
Questions ofthe Agency.
The order ofthe second hearing,will be determined at the beginning of the second hearing.
