Environmental Protection Agency by Section

of the Illinois Environmental Protection Act ,415
ILCS 5/31.1(2002).
FACTS
1.
That
Respondent,
Knox
County
Landfill
Committee,
is the
permitted
owner
and
operator of Knox County Landfill #3, a facility located in
rural Knox County,
near Wataga,
Illinois.
2.
That Respondent,
Greg
Ingle,
is the Certified Operator
of the above-referenced
facility.
3.
That
said
facility
is
operated
as
a
sanitary
landfill,
operating
under
Illinois
Environmental Protection Agency Permit No. 1994-1 05-LFM, and is designated with Site Code No.
0958160003.
The facility is commonly known to the Illinois
Environmental Protection Agency as
Knox County Landfill #3.
5.
That Respondents have owned
and/or operated said
facility at all times pertinent
hereto.

6.
That on
September 24, 2004,
Jeffrey Port of the Illinois
Environmental Protection
Agency’s Peoria Regional Office inspected the above-referenced facility.
A copy of his inspection
report setting forth the results of said inspection
is attached hereto and
made a part hereof.
VIOLATIONS
Based upon direct observations made
byJeffrey
Port during the course of his September
24, 2004 inspection of the above-referenced facility, the Illinois
Environmental Protection Agency
has determined that Respondents violated the
Illinois Environmental Protection-Act-(hereinafter, the
“Act”) as follows:
(1) That Respondents conducted a sanitary landfill
in a manner-whFch-resulted4n-uncovered
refuse remaining from any previous operating.day or at the conclusion of any operating
day,
a violation of Section
21
(o)(5) of the Act, 415 ILCS 5/21
(o)(5)
(2002).
CIVIL
PENALTY
Pursuant
to
Section
42(b)(4) of the
Act,
415
ILCS
5/42(b)(4)
(2002),
Respondents
are
subject
to
a
civil penalty of
Five
Hundred
Dollars
($500.00) for each
of the violations
identified
above, for a total of Five Hundred
Dollars ($500.00).
IfRespondents elect notto petition the Illinois
Pollution Control Board, the statutory civil penalty specified above shall be due and payable no later
than December15, 2004,
unless otherwise provided byorderofthe Illinois Pollution Control Board.
If Respondents elect to contest this Administrative Citation by petitioning the llinotsPollution
Control Board in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatoryhearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental

Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in
addition
to the statutory
civil penalty.
Pursuant to Section 31.1 (d)(1) of theAct, 415 ILCS 5/31.1 (d)(1) (2002),
if Respondentsfail
to petition or elect notto petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35)
days of the date of service,
the Illinois Pollution
Control Board shall
adopt a
final
order,
which
shall include
this Administrative
Citation and
a finding
of violation
as
alleged herein, and
shall impose the statutory civil penalty specified above.
When
payment
is
made,
Respondents’

shall
be

Illinois
Environmental
Protection

Pollution Control Division of the Illinois Environmental
Protection Agency and has been so employed at all times
pertinent

2004, between 5:08 AM and 8:40 AM,
Affiant conducted an inspection of the Knox County Landfill
•in
Knox County,
Illinois, kn9wn as Knox County Landfill
#3,
Illinois Environmental Protection Agency Site No.
0958160003,
operating under IEPA Permit #l994-lOS-LFM.

Affiant inspected said Knox County Landfill #3
site by
an on-site inspeOtion, which included waJ~kingthe site and
interviewing personnel.
4.
Before and/or after said inspection of said landfill
site, Affiant reviewed Illinois Environmental Protection Agency
permits issued to the subject site and investigated into whether
or not required documents were timely filed on behalf of the
subject site.
5.
As a result of the activities referred to in
Paragraphs
3 and 4 above, Affiant completed the Inspection Report
form attached hereto and made a part hereof,

September 24, 2004, I (JeffPort) performed a
Solid
Waste Landfill Inspection at the
Knox
County
Landfill #3 located in
rural Knox County,
nearWataga. The facility
is an 814
Subpart C
landfill with authorization under Permit
#1994-105-LFM
issued
on September
29,
1994.
The
mostrecent modification, #20 was issued onJuly 2, 2004.
I
arrived at
the site
at
5:08
AM.
I was
accompanied
by Dawn Ingold,
DLPC/FOS
Peoria.
The
entrance gate
to the facility was locked but the exit gate was open,
so
we proceeded
through the
exit gate.
Two
trucks wereleaving the site. I explained
to
one of
the drivers thatwewere going
to
perform
an inspection at the site.
We
then went
to
the office
and
found
that
the door was
locked. We
next
proceeded
out to
the landfill.
Webegan the inspection
at Cell 3.

The facility had begun placing

a well-developed footprint here.

After completing the other inspections, we went to the office were I reviewed facility records.
I
examined the load checks and cover reports.
These items appeared
to be in order.
After further
discussion with Mr. Ingle, we left the site at 8:40 AM.

Based upon this
inspection,
the
following
violations
were
found
to
be
continuing
and
are
indicated
on
the
accompany
checklist.
1.
Pursuant to
Section
21 (d)(1) of the
Illinois
Environmental
Protection Act

5/21(d)(1)),
no
person
shall
conduct
any
waste-storage,
waste-treatment,
or
waste-
disposal
operation
without a
permit
granted
by
the
Agency
or
in
violation
of any
conditions imposed by such permit.
A violation of Section 21(d)(1)
is
alleged for the
