MOTION FOR EXTENSION OF TIME TO FILE RESPONSE
NOW COMES the Respondent, the Illinois Environmental Protection Agency (“Illinois
EPA”), by one of its attorneys, John J. Kim, Assistant Counsel and Special Assistant Attorney
General, and, pursuant to 35 Iii. Adm. Code 101.500, 101.520 and 101.522, hereby requests that
the Illinois Pollution Control Board (“Board”) waive the normal filing requirements of 35 Ill.
Adm. Code 101.520(b) and grant the Illinois EPA an extension of time within which to file a
response to the Petitioner Village ofRobbins’ motion to reconsider. In support of this motion,
the Illinois EPA states as follows:

The Petitioner, Village ofRobbins, filed a motion to reconsider with the Board on
October 19, 2004. Pursuant to 35 Ill. Adm. Code 101.520(b), a response to the motion to
reconsider is to be filed with the Board within fourteen (14) days after the filing ofthe motion.
Accordingly, the response is due on or before November 3, 2004. The
14th
day after the filing is
actually November 2, 2004, which was a State holiday.
Pursuant to 35 ~II1.Adm. Code
101.300(a), the next business day (November 3, 2004) would then be the due date for the
response.

In the time between service of the motion and the required date for filing the
response, the undersigned counsel for the Illinois EPA has been expending time and resources in

the negotiations and settlement of several other cases. Also, a State holiday fell within that time
period, which further delayed the preparation and finalization ofthe response.

The Illinois EPA is seeking a limited extension of time by which to file the
response to the motion to reconsider of no more than two business days, or until November
5,
2004.
WHEREFORE, for the reasons stated above, the Illinois EPA hereby respectfully
requests that the Board grant the Illinois EPA an extension of time to file the response to the
motion to reconsider to November
5,
2004.
