PETITIONER’S MOTION TO THE
ILLINOIS POLLUTION CONTROL
BOARD
FOR VOLUNTARY DISMISSAL OF NPDES PERMIT APPEAL
Now
comes
the
Petitioner,
Metropolitan
Water
Reclamation
District
of
Greater
Chicago
(“District”), by
its
Attorney,
Michael
G.
Rosenberg,
and
requests
that
the Illinois
Pollution Control Board dismiss
the District’s Petition for NPDES Permit Appeal.
In support
hereof, the District states as follows:
1.
On January 29, 2002,
the District filed a Petition for NPDES
Permit Appeal with the
Illinois Pollution
Control Board
(“IPCB”).
The appeal pertained to NPDES
Permit Number
IL0036340
issued
to
the
District
for
its
Egan
Water
Reclamation
Plant
by
the
Illinois
Environmental
Protection
Agency
(“IEPA”).
The
appeal
challenged
certain
terms
and
conditions in the permit.
2.
On February 7, 2002,
the IPCB accepted the District’s petition for hearing.
The
IPCB
subsequently assigned Hearing Officer Bradley P. Halloran to this appeal.
3.
On
September
13,
2004,
the
IEPA issued
the Egan
WRP
a
modified
permit.
The
permit
was
further modified
on
October
14,
2004.
The
modifications
have
satisfactorily

resolved one
or more
of the
issues under
appeal.
Therefore,
the
District
requests
that
the
instant appeal be dismissed.
WHEREFORE,
the
Metropolitan
Water
Reclamation
District
of Greater
Chicago
requests that the instant NPDES permit appeal be voluntarily dismissed.
