HEARING OFFICER ORDER
On October 28, 2004, the parties informed the hearing officer that they have reached a
settlement in principle and that the respondent is in the process of forwarding a written proposal
to the petitioner for review. If accepted, the petitioner anticipates filing a motion to voluntarily
dismiss the above-captioned matter.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 22, 2004, at 9:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss this matter is filed prior to the next status conference, the status conference will be
cancelled without further order.
