HEARING OFFICER ORDER
On October 21, 2004, al parties participated in a telephonic status conference with the
hearing officer. The petitioner made an oral motion for an extension of time to file its response
to respondent’s motion to dismiss filed October 20, 2004, and respondent’s motion for an
extension of time to file the record filed October 14, 2004. The respondent had no objection.
Petitioner’s motions are granted. Petitioner’s response to respondent’s motion to dismiss and its
response to respondent’s motion for an extension of time to file the record are now due to be
filed on or before November 12, 2004. The petitioner represented that it will file a 90-day
waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 16, 2004, at 10:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
