HEARING OFFICER ORDER
On October 27, 2004, a telephonic status conference was held. Respondent did not
appear due to a conflict. Petitioner represented that discussions continue regarding the
possibility of filing a motion to voluntarily dismiss this matter and requested that that any
telephonic status conferences and rulings in this matter, including the fully briefed and pending
cross-motions for summary judgment, be continued for an additional 90 days. That request is
granted.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on January 20, 2005, at 10:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
