    ORDER OF THE BOARD (by T.E. Johnson):
     
    This matter is before the Board on a complaint filed by the Office of the Attorney
    General, on behalf of the People of the State of Illinois (People), against Danny Wiegel d/b/a
    Wiegel’s Tree Service (Wiegel). The complaint concerns allegations that Wiegel violated
    Sections 9(a) and (c) of the Environmental Protection Act (415 ILCS 5/9(a) and (c) (2002)) by
    causing or allowing the burning tree trimmings, wood, logs, limbs, chips and other waste at his
    tree service business at 1130 Cody Road in Centralia, Marion County.
     
    On October 18, 2004, the People filed a motion for voluntary dismissal. In the motion,
    the People assert that Wiegel is recently deceased, and as a result the tree service is no longer in
    existence. The People contend that the violations have been abated and ask the Board to dismiss
    the case without prejudice. The motion is granted. The Board hereby dismisses the complaint,
    and closes the docket.
     
    IT IS SO ORDERED.
