HEARING OFFICER ORDER
On October 21, 2004, the remaining parties participated in a telephonic status conference
with the hearing officer. The complainant represented that it recently forwarded a counter-offer
to the respondent Roberts Environmental Control, Inc., (Roberts) for its review. The parties
represented that they will submit a proposed discovery schedule on or before October 29, 2004.
Complainant’s represented that it will not file a response to Robert’s affirmative
defenses.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 21, 2004, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
