Robert

Tony
Thompson
(“Thompson”)
are
the
owners
of property
located
at
4th
and
Jefferson,
Cairo, Alexander
County,
Illinois.
The site
had
underground
storage
tanks
(“USTs”)
on
the
property,
which
stored
gasoline.
2.
LUST
Incident
Number
20020881
was
obtained
following
a
site
investigation and LPC #0030055049
was assigned.
3.
On
May
19,
2004,
the
Agency
received
Thompson’s
Site
Investigation
Completion
Report
and
a
Corrective
Action
Plan
to
remove
the
contaminated soil identified in the Site
Investigation Completion Report.

The Agency
approved the Site Investigation Completion Report (“SICR”),
which
delineated
the extent of contamination in
a letter dated
September
13, 2004, a copy ofwhich is attached hereto as Exhibit A.

The
Agency
denied
the
work proposed
in
the
Corrective
Action
Plan
(“CAP”)
to
remove the contaminated
soil
as delineated
in
the
SICR in
a
letter
dated
September
15,
2004,
a
copy
of which
is
attached hereto
as
Exhibit B.
6.
Thompson is appealing this September
15,
2004 denial.
7.
Thompson
disagrees
with
the
Agency’s
decision
and
believes
that
the
work described in the
CAP
are reasonable
corrective action
activities
and
are
necessary
to
meet
the
minimum
requirements
under
the
Act
and
implementing regulations.
8.
The
Agency’s
letter
denying
the
CAP,
Exhibit
B,
provides
no
further
explanation of the
Agency’s
reasons
or
bases
for
denial
that
could
aid
Petitioner
in
setting
forth
its
grounds
of
appeal.
Nevertheless,
the
Agency’s denial is a final decision that Petitioner must appeal to the Board
in order to
preserve and enforce Petitioner’s right to
reimbursement under
the UST Fund.

2003, the Agency has determined that the proposed plan exceeds the minimum
requirements for remediation as set forth by Public Act 92-05 54, and 35
Illinois Administrative
Code (35 Ill. Adm.
Code).
According to
analytical results presented in
the Site Investigation
Completion Report, no contamination was present in any of the soil borings advanced
at the
site.
The
Site Investigation Status Report indicated that contamination was present in three (3) grab
samples tai~en
from the former tank bed floor and the island pumps.
The Agency has determined

An underground storage tank owner or operator may appeal
this final decision to the Illinois
Pollution Control
Board pursuant to
Sections 40 and 57.7(c)(4)(D) ofthe Act by filing a petition
for a hearing within 35 days after the date ofissuance ofthe final decision. However, the35-day
periodmay be extended for aperiod of time not to exceed 90 daysby written notice fromthe
owner or operator and the IllinoisEPA within the initial 35-day appeal period.
If the owner or
operatorwishes to receive a 90-day extension, a written request that
includes a statement ofthe
date the final decision was received, along with a copy of this
decision, must be
sent to the
IllinoisEPA as soon as possible.
