ORDER OF THE BOARD (by G.T. Girard):
Section 9.1(e) of the Environmental Protection Act (Act) requires the Board to adopt
regulations which are “identical in substance,” as defined at Section 7.2 of the Act, to
exemptions from the definition of “volatile organic material” (VOM) those compounds that the
United States Environmental Protection Agency (USEPA) has found to be exempted from
regulation under state implementation plans for ozone due to negligible photochemical
reactivity. USEPA has codified these exemptions as part of its definition at 40 C.F.R.
51.100(s). Accordingly, the Board reserved this docket for USEPA amendments during the
    period from January 1, 1998, through June 30, 1998.
During the period from January 1, 1998, through June 30, 1998, USEPA amended its
definition of VOM on April 9, 1998, at 63 Fed. Reg. 17331, to add methyl acetate to the list
of chemical species that are exempted from the definition of VOM and, hence, are exempted
from regulation for control of ozone precursors. The Board added this compound to its action
in docket R98-17, which adopted on July 6, 1998. USEPA made no further amendments to its
definition of VOM during the timeframe of the present docket.
For the foregoing reasons, the Board hereby dismisses this proceeding.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, do hereby certify
that the above order was adopted on the _______ day of ___________________, 1998 by a
    vote of ________.
