    ORDER OF THE BOARD (by T.E. Johnson):
     
    This matter is before the Board on a complaint filed by Mate Technologies, Inc. (Mate)
    against F.I.C. America Corporation (FIC) alleging that FIC violated provisions of the
    Environmental Protection Act and Board regulations by failing to contain or control the oil
    disseminated from its operations and allowing the release of oil through windows, doors and
    other openings in the building and via storm sewers at property located at 4750 Rohlwing Road,
    Itasca, in Cook County.
     
    On October 4, 2004, Mate filed a motion for voluntary dismissal with prejudice. In the
    motion, Mate asserts that the parties have settled all matters at issue in the complaint. Mate also
    represents that FIC has indicated it will not file any response to the motion. The motion is
    granted. The Board hereby dismisses the complaint with prejudice, and closes the docket.
     
    IT IS SO ORDERED.
