    HEARING OFFICER ORDER
     
    On October 5, 2004, the parties contacted the hearing officer separately regarding this
    matter. Petitioner was not aware of any progress regarding its proposed ELUC (Environmental
    Land Use Covenant). Respondent subsequently contacted the hearing officer to report that it has
    approved the ELUC, and the parties need to discuss the technical details before this case may be
    dismissed. Respondent’s attorney had emailed this information to petitioner’s attorney, but
    apparently it was not received. Petitioner agreed to file an additional waiver of the decision
    deadline to February 28, 2005 within the next seven days.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 2:00 p.m. on October 28, 2004. The status conference shall be initiated by the
    petitioner. At the status conference, the parties must be prepared to discuss the status of the
    above-captioned matter.
     
    The decision deadline is currently January 31, 2004.
