HEARING OFFICER ORDER
On September 30, 2004, a telephonic status conference was held. Respondent did not
appear. The petitioner represented that it is awaiting the outcome of the related adjusted
standard petition now pending before the Board. The petitioner represented that it will file a
waiver of the statutory decision deadline to and including April 7, 2005. Respondent is
reminded to file its appearance.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 2, 2004, at 10:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
