HEARING OFFICER ORDER

On September 30, 2004, all parties participated in a telephonic status conference with the
hearing officer. The complainant made an oral motion for an extension of time to file its
response to respondents’ motion to dismiss. Over respondents’ objection, the complainant’s
response to the motion to dismiss is now due to be filed on or before October 4, 2004. The
complainant represented that it may also file a motion to consolidate, which is also due to be
filed on or before October 4, 2004. The respondents represented that they may file a reply to
both of complainant’s pleadings.

The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on November 18, 2004, at 9:15 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.

IT IS SO ORDERED.
